Latest updates on British Sikh tortured and detained in India
In November 2017, respected Scottish Sikh activist Jagtar Singh Johal was in India for his wedding. When out shopping with his wife, he had a sack thrown over his head and was bundled into a van. Days later he was implicated in a murder case. He has since reported being tortured to the UK Consulate. Eight years later, he has not been formally charged with a crime. Learn more from our timeline below.
Sikhs and human right supporters across the world remain vocal in support of the #FreeJaggiNow campaign. The case of Jagtar Singh is an example of the undeniable continuing trend of Indian authorities targeting and detaining dissenters of the state. For further information, or for comment from members of the Sikh community/interview opportunities, email Media@SikhPA.com.
- Jaggi is detained on allegations of financial links with Sikh freedom fighters that are accused of crimes against Indian Hindutva nationalists
- Jaggi currently has nine cases that have been at pre-trial stage since 2017. Trial for a 9th case began in 2020 after 2.5 years
- Court hearings are continually deferred without evidence against Jaggi presented, allowing Jaggi’s defence no opportunity to prove his innocence

70th trial hearing sees Chief Prosecutor brazenly lie
The 70th trial hearing at Patiala House (Delhi) for eight cases against Jagtar Singh Johal saw no proceedings again, as witnesses unrelated to Jaggi’s allegations were cross-examined instead.
However, the prosecution have now claimed a witness they are depending on regarding cases against Jaggi is in the UK, creating another intangible delay. This was revealed via submission from the prosecution to India’s Supreme Court, whilst different court submissions by the prosecution state different things entirely, once again exposing the clownery of India’s judicial processes. To underline just how ridiculous the prosecution’s behaviour is, for some reason the Chief Prosecutor claimed they had never attended any Supreme Court hearings, where they have been visibly in attendance.

Jaggi moved to notoriously dangerous Delhi prison
In a move which has been protested against by his campaign team, Scottish Sikh political prisoner Jagtar Singh Johal was moved from Mandoli Prison to the notorious Tihar Jail two weeks ago, raising concerns for his safety.
Tihar Jail is a facility so notorious for violence that British courts have ruled people may not be extradited there. Conditions inside the jail have been called “not fit for humans”. Gurpreet Singh Johal, Jagtar’s brother, said: “Any prison in India is a dangerous place for a human rights activist, but Tihar is among the very worst.
“It is terrifying to think of my brother locked up there. The risk that he could be attacked or even killed is not theoretical – it’s a daily reality. The UK Government is playing with Jagtar’s life.”
In 2023, two high-profile murders took place inside and there have been at least 23 deaths in custody in Delhi this year, including suspicious deaths and multiple suicides. Sources also state at least 12 “unnatural deaths” occurred in the jail in 2025.

Human rights campaign group Reprieve has represented Jagtar and called for his release by Indian authorities.
Dan Dolan, Deputy Executive Director of Reprieve, said: “British courts have found that Tihar jail is so dangerous people can’t be extradited there, but now an arbitrarily detained British citizen has been sent there – and his Government is showing no urgency to get him out.
“That it has taken eight years and counting to bring Jagtar home is shameful, and while the last Government must share the blame, the current Government has also failed for more than a year. If they don’t act soon this failure could end in catastrophe.”

“It is impossible to describe the pain of being separated from Jagtar for so long. We were just beginning our life together, full of hope and love. When I look at the picture of us dancing, so happy, with the rings on our fingers symbolising our vows to each other, it makes me unbearably sad.
“I think of the years, the life that has been taken away from us. I don’t care about the gold chain or even the ring – I just need Jagtar back to start our married life together.”
Jaggi’s wedding ring stolen, claimed as “missing” by Indian authorities
Valuable items of jewellery Jaggi had in his possession when he was first kidnapped have now been claimed as “missing” by Indian authorities, including the Scotsman’s wedding ring.

UK Foreign Secretary criticised after Modi meet
Labour Party Foreign Secretary David Lammy was criticised by the #FreeJaggiNow campaign team for posing with India’s Prime Minister Narendra Modi without raising the plight of Scottish political prisoner Jagtar Singh Johal.
Lammy was on an official government trip to India, whilst Jaggi remains imprisoned arbitrarily in India for nearly eight-years, even after recently being acquitted on all his original charges he was arrested for. In a video statement, Gurpreet Singh Johal – brother of Jaggi and lead of the #FreeJaggiNow campaign – described his meeting today with Labour’s Foreign Secretary David Lammy as “disappointing”, with a lack of urgency in taking up the case with India evident.
Watch it here-
The lack of opportunity for such face-to-face meetings with the Foreign Secretary makes Gurpreet Singh’s response extra impactful. Previous Foreign Secretaries did not meet with the family more than once.
The UK government just officially confirmed a new trade deal with India yesterday, something which is often cited as playing a role in the UK’s lack of urgency in pressing India to free Jaggi. Ex-MP Martin Docherty-Hughes (SNP, West Dunbartonshire) previously said the UK is sacrificing Jaggi in the name of trade with India.

Jaggi being tortured with solitary confinement after acquittal news
Jaggi’s brother revealed the Scottish Sikh political prisoner is being kept in solitary confinement since news of his acquittal in half of the cases against him.
The move to keep Jaggi alone, which also came with several other of his “privileges” being removed, portrays India’s judicial staff as spiteful and determined to make Jaggi suffer, especially since the recent validation of his claim of innocence through the acquittal of half the cases against him.

See a video of Jaggi’s brother – respected lawyer and lead of the #FreeJaggiNow campaign Gurpreet Singh – explain the acquittal here.
Sikh groups and human rights supporters across the globe have welcomed the news, although the fact there is another trial with at least eight charges left (which can be increased as per India’s judicial system) means many understand there is still a long way to go before Jaggi is home in Scotland. 144th trial hearing sees judge FINALLY close prosecution evidence
The 144th trial hearing at Bagha Purana (Moga, Punjab) court saw the presiding judge finally close the call for evidence to the prosecution, after nearly eight years of delay.
The decision came after a witness without relevance to Jaggi, who was videoed into the hearing, was presented before the court. The judge’s decision means the prosecution will not be allowed any more time to present evidence, which has been the subject of most deferments, prolonging the trial process and keeping Jaggi imprisoned indefinitely.
In 2017, Indian Chief Minister infamously claimed after the arrest of Jaggi that several cases of alleged terrorism were now “solved” with his arrest. Despite the judge’s decision today, it is likely the prosecution will find new ways to delay and defer the trial process. The next hearing is booked for 15th January.

One protected prosecution witness was cross examined in a case not related to Jaggi. However, the incompetence of the NIA was on display, as the so-called protected witness was protected in a couple of cases but not in others, leading to his identity being revealed and rendering NIA efforts to protect him baseless. Also, for some reason the NIA had this witness record his statement for the court in English, only for it to be revealed he cannot speak nor understand English. MPs “depressed” over Sunak’s lack of action on Jaggi
Three different MPs delivered damning comments on Rishi Sunak’s lack of action on Jaggi’s situation in Delhi last week in UK parliament today.
Conservative Alicia Kearns, who chairs the Foreign Affairs Committee, said MPs were unclear about the outcomes of the discussions.
She said: “Will the Government now finally officially call for him to be released because the UN has accepted he is arbitrarily detained and does the Prime Minister believe that he has been unfairly treated or even tortured whilst he’s been held?”.
Martin Docherty-Hughes, the SNP MP for Jaggi’s hometown of West Dunbartonshire, said: “Given the widespread concerns in this place and outside of the leaking of this Government’s resolve to Jagtar Singh Johal, particularly in relation to getting a trade deal over the line, would the Prime Minister agree to meet with me and Jagtar Singh Johal’s family so he can tell them exactly what he intends to do on their behalf?”.
Labour MP Sir Chris Bryant, newly appoint to Labour’s shadow cabinet, added: “Surely one of the things that should keep the Prime Minister awake at night is whenever a British national is arbitrarily detained in a foreign country.
“You would hope that ministers, and the Prime Minister himself, would summon up every ounce of energy to try and get people released.
“I’m sorry but I think quite a lot of us are very depressed by the Prime Minister’s own answer to (Ms Kearns) earlier about Jagtar Singh Johal, who has been arbitrarily detained now for six years.
“Everybody knows that he is being tortured and that he is being mistreated.
“I took the Prime Minister to say that he has not called for his release. Is that really the truth?”.
Sunak’s responses to all three were generic claims about his govt regularly raising the issue through the Foreign Office.
Meanwhile MP Preet Kaur Gill (Labour, Edgbaston) said it was “shocking” Sunak is not calling for Jaggi’s release in a Tweet, whilst she also expressed similar sentiment in an BBC Asian Network interview today.

The lead of the #FreeJaggiNow campaign has responded to Rishi Sunak saying he raised Jaggi’s case with Modi, saying the UK PM is all “talk and no action” after Rishi Sunak raised his case with Indian Prime Minister Narendra Modi at the G20 summit.
Gurpreet Singh Johal said raising his brother’s case was “not enough” unless the British Prime Minister called for Jagtar’s release. Gurpreet Singh said of the situation, “Clearly, the Prime Minister had no option other than to raise Jagtar’s case, after so many MPs demanded he do so”. Gurpreet also said that without “details” of what was discussed the claim from Sunak is “meaningless”.

Rishi Sunak has raised the case of detained Scots man Jagtar Singh Johal with the Indian Prime Minister at the G20 summit in New Delhi today. The UK Prime Minister confirmed he brought up Jagtar’s case with Narendra Modi during a meeting, alongside a range of other consular issues. Although no real details of what was discussed and how India responded were revealed, Sunak claimed he was able to raise the issue “alongside a range of other consular issues that Prime Minister Modi and I discussed in the time that we had”.

UK decides not to call for release of Jaggi
A letter sent to Jaggi’s local MP Martin Docherty-Hughes stated the UK govt will not seek the release of the Scottish Sikh political prisoner.
The letter from Asia Minister Lord Ahmad, who has previously been criticised for ignoring Jaggi’s situation despite promising to raise it when meeting with Indian officials, was sent in response to a request from Docherty-Hughes to have the situation raised at the G20 summit in Delhi.
The letter said “Having carefully considered the potential benefits and risks to Mr Johal of calling for his release, as well as the likely effectiveness of doing so, we do not believe this course of action would be in his best interests.”
Lord Ahmed wrote that with Johal’s trial underway in India, a call for his release would be considered interference in the Indian judicial process, which could jeopardise UK’s ability to offer consular assistance.
The response came after a group of more than 70 MPs called on Sunak earlier this week to urge Prime Minister Narendra Modi to secure Johal’s “immediate release”.
Jaggi’s brother, spokesperson and head of the #FreeJaggiNow campaign Gurpreet Singh, said the UK have “left Jaggi to rot”.

Prominent Sikh activist, supporter of #FreeJaggiNow, passes suspiciously
The Sikh world was today shocked to learn Bhai Avtar Singh Khanda passed away after a sudden deterioration in his health. Khanda was a prominent supporter of the #FreeJaggiNow campaign, as someone who himself was targeted by India due to his Sikh activism. His family are seeking independent examination into his passing, with suspicions he may have been poisoned. In April, Gaurav Arya, a Hindu extremist former Indian Army Major turned Youtuber, made a video saying Khanda would soon be “finished – eliminated” by India.
Jaggi has released a message about the passing via his brother Gurpreet. See it here- (7) Facebook.

100th Delhi trial hearing sees no proceedings
The 100th trial hearing for the Bagha Purana court hearings (Moga, Punjab) symbolically was immediately adjourned without proceedings. The next hearings are set for early July.
With no 100 trial hearings having taken place, it is a damning indictment of India’s judicial process that progress remains so minimal for Jaggi’s cases.

Jaggi’s defence remains waiting for an opportunity to counter allegations against the Scot. The next hearing has been scheduled for 6th June.

Jaggi reaches 2000 days imprisoned in India
Scottish Sikh political prisoner Jagtar Singh Johal has reached 2000 days imprisoned in India today.
To date, Jaggi remains yet to be officially charged for any crime. As trials go on, his defence team are yet to receive any consistent opportunities to defend him from the allegations against him, due to the Indian State’s tactic of dragging up the judicial process to keep Jaggi incarcerated for as long as possible without having to prove he has committed any crime.
Human rights support groups across the world remain campaigning for his freedom.

Police officer implicated in Jaggi case sacked for major drug trafficking
Punjab Chief Minister Bhagwant Mann on 17th April ordered the dismissal of Punjab Police Service (PPS) officer Raj Jit Singh, acting on reports about an alleged nexus between police officers and drug traffickers in the state.
Raj Jit Singh is an officer that was involved in the arrest of Jagtar Singh Johal. Whilst Indian media claim Sikh activism is entwined with the drug epidemic in Punjab, noted panth (Sikh community/path) activists like Bhai Amritpal Singh have worked to end drug dealing and addiction across Punjab, which has led to Punjab Police attempting to crush the social reform movement.

Jaggi’s lawyer detained amid #PunjabUnderSiege operation targeting Sikhs
Jaspal Singh Manjhpur, the respected human rights lawyer heading Jaggi’s case, has been detained amid the #PunjabUnderSiege situation.
Indian authorities have carried out a mass operation targeting govt critics, Khalistan (free Sikh homeland) supporters and those exposing India’s human rights abuses. Over 1500 have been detained in the operation supposedly triggered by an attempt to arrest Bhai Amritpal Singh, a respected Sikh leader heading an anti-drugs social reform campaign in Punjab.
UPDATE- Manjhpur was released the same day, although 1000+ more are still detained. See a video statement from him (in Punjabi) here- (3) Facebook

93rd trial hearing sees Jaggi fail to appear, reason not given

17.03.23
4th trial hearing sees same witness examined as last time, with maybe 200 more left to examine
Jaggi appeared via video link at Patiala House (Delhi). The same witness from the previous hearing was cross examined in five NIA cases (RC 18/22/25/26/27) but not the 6th case (RC 7).
- The judge has adjourned until 26 April 2023 for the 6th case (RC 7)
- The judge has adjourned 3 cases (RC 22/23/26) to 12 May 2023
- The judge has adjourned 4 cases (RC 18/24/25/27) to 19 May 2023
It is worthwhile noting despite today being the 4th Trial Hearing only one witness has been partially cross examined to date, the NIA allege there are over 200 witnesses in each case. It is clear the NIA are happy moving at this pace as the Trial will take over 10 to 15 years to conclude at this rate.
The UK Government need to take the “extreme action” promised in Parliament in November 2017 to bring Jaggi back home.

Free Jaggi Now supporters disgusted at UK govt denying Jaggi’s torture
In papers lodged at the High Court of Justice in response to Jaggi’s legal claim that the UK govt have ignored/facilitated his torture in India, the UK government said the torture allegations were not admitted. It said they would be required to be heard in full in front of a judge before confirmation.
In court papers, its lawyers write: “For the avoidance of doubt, the allegations of torture and/or inhuman or degrading treatment by the Punjab Police… are not admitted.”
UK govt lawyers even claimed Jaggi looked “fine” when visited by a UK consulate official days after his capture. Jaggi stated in his letter on his torture it was all done below his neck to keep signs of it hidden.
Gurpreet Singh Johal said he was “extremely disappointed” by the UK government’s response to his brother’s legal claim.
He told the BBC: “For years, ministers and consular staff have been telling me they take Jagtar’s torture claims seriously and that there should be an independent investigation.
“So for the lawyers to question that, now that it’s come out that Britain’s intelligence services might have played a role in his abduction, is very hurtful.”
Foreign Office ask for Jaggi’s torture claim to be heard in secret
The Foreign Office has asked for claims to be examined in a secret court that a British citizen was detained and tortured after the security services passed intelligence to the Indian government, newly filed court papers show.
The government department is refusing to confirm or deny claims that Jagtar Singh Johal (“Jaggi”) was detained in India in 4 November 2017 after an alleged tipoff to the Indian security services.
Former Conservative cabinet minister David Davis said: “This case raises troubling questions about the role played by the UK’s intelligence services in the abduction and torture of a British citizen overseas. It is telling that the government is willing to say nothing at all about what happened to Jagtar but has sought immediately to move the case into a secret court. I am also disheartened to see the government casting doubt on Jagtar’s very credible claims of torture and mistreatment, when the [Foreign Office] has raised these so many times with the Indian authorities.”

3rd trial hearing in Patiala court cases sees only one of five witnesses attend
Jaggi appeared via video link at Patiala House, Delhi for the second set of four NIA cases put against him (as opposed to non NIA cases). The trial for these four cases started today and five witnesses were summoned but only one attended.
The fact four witnesses failed to attend highlights the prosecution’s attitude towards the trial, with it clearly being needlessly dragged out to keep Jaggi imprisoned. The presiding judge has bundled all eight NIA cases together, meaning each witness will be called eight times to give evidence in each case before moving on to the next witness. Once again, the Prosecutions tactics of prolonging matters has worked. The trial on all eight cases will continue on 17 March 2023.
The Free Jaggi Now team said of the trial: “The NIA and the Prosecution have made a mockery of the Indian Judicial system. The UK Government continue to stand by and watch as a British national languishes in an Indian jail for the past 1953 days.”

92nd trial hearing sees four witnesses questioned, none related to Jaggi
The 92nd trial hearing for cases against Jaggi being heard at Bagha Purana court (Moga, Punjab) saw no progress on his situation, despite the prosecution examining four alleged witnesses.

Labour leader says Tory govt “scaling back support” for Jaggi
Labour Party leader Sir Keir Starmer has claimed that “Rishi Sunak’s government may now be backsliding” on support for British Sikh political prisoner Jagtar Singh Johal.
The statement comes after Starmer wrote to Rishi Sunak last month asking the Prime Minister to “confirm if the UK government still believes that Jagtar is being arbitrarily detained and if so, what further steps your government will take to secure a breakthrough in the case?” .
Sunak’s response ignored the question, instead vaguely claiming the Foreign Office “continues to provide consular support”. Speaking on the response, Starmer said he is “concerned that in his response to my letter and in discussions with Jagtar’s family, Rishi Sunak’s government may now be backsliding on their previous stance”, referring to the previous PM Boris Johnson publicly labelling India’s imprisonment of Jaggi as “arbitrary”. Johnson’s statement in June 2022 followed a UN report which also called India’s imprisonment of Jaggi “arbitrary”. Labour MPs including the first Sikh female MP Preet Kaur Gill have come out in support of Starmer’s statement.
Steir added, “UN experts have been clear that Jagtar shouldn’t be made to suffer in prison a day longer. It is the duty of the British government and political parties in Westminster to make proper representations and do what it takes to bring him home to his family in Dumbarton.”

Other media outlets have highlighted how “the bill creates a “blueprint for authoritarian governments around the world to threaten journalists, activists and whistleblowers”.
Speaking on this, Sikh PA Senior Press Officer Jasveer Singh said, “It is concerning to learn that the UK government is attempting to protect its own and relationships with foreign powers ahead of its own citizens, who may end up being targeted for silencing if we raise issues against a country like India. This will no doubt concern countless British Sikhs regarding the ongoing fascism in India, which much of the community suffer from.”

Rishi Sunak’s “extradition” response to Jaggi question prompts concerns
A question from an SNP MP towards Prime Minister Rishi Sunak regarding whether he raised the plight of Jagtar Singh Johal during his recent meets with India’s PM Narendra Modi prompted a worrying response where Sunak mentioned he is discussing “extradition” between India and the UK.
This will concern British Sikhs, many of whom are still looking for answers around the #WestMidlands3 incident in 2021. The Conservative govt are still yet to explain why they allowed India’s extradition attempt for three British Sikh men – which would have put them on the death sentence – when it was found during a court hearing there was no viable evidence to support an extradition attempt. British Sikh orgs have been open about the belief the men were actually targeted by India for their work exposing India’s anti-Sikh human rights abuses. There is a strong belief that enabling extradition to India will see more Sikhs targeted in this way.

Fears for Jaggi as new law allows govt to enable torture
The National Security Bill being debated in the Commons on Wednesday will update espionage laws for the modern era, and includes tougher offences for people who collaborate with foreign intelligence agencies.
But in a joint letter to Rishi Sunak, a group of organisations, including Reprieve – who are supporting the #FreeJaggiNow campaign – and Liberty, say the Bill’s clause 27, which exempts UK security agencies and the government from committing a criminal offence in assisting foreign agencies, gives legal cover for them tipping off other states in cases of torture or extraordinary rendition.
The calls to remove clause 27 have been backed by a cross-party group of MPs, led by Conservative former minister David Davis and Labour MP and former soldier Dan Jarvis.
The contentious measure would make the new laws exempt in circumstances to allow “the proper exercise of any function of the Security Service, the Secret Intelligence Service or GCHQ, or … the proper exercise of any function of the armed forces”.
This could include UK government officials or ministers giving a tip off which leads to the torture of a suspect abroad – which MPs and campaigners say goes against the UK’s centuries-old legal prohibition on torture.
Jaggi not produced for 84th trial hearing

Labour believe Boris Johnson tipped-off UK intelligence about Jaggi
Labour’s Shadow Foreign Secretary has accused Boris Johnson of being behind the intelligence tip-off to India which led to the abduction and torture of Jagtar Singh Johal.
Catherine West, a shadow foreign minister, said: “The allegations in recent weeks of the potential collusion of the British intelligence service in the arbitrary detention of Mr Johal are deeply worrying. The house will expect the minister to be clear on whether the former prime minister [Johnson], under whose watch this occurred, we believe, authorised sharing this intelligence with the Indian government when he was the foreign secretary.”
The statement was made during a discussion based on an Urgent Question Jaggi’s local MP Martin Docherty-Hughes was allowed to raise in parliament today.

British spies caused Jaggi’s arrest, UK Govt to be sued for it
The UK Govt is being taken to court after it was found spies of MI5 and MI6 supplied information which led to Jagtar Singh Johal’s “unlawful arrest”, according to a human rights group overlooking his case.
Reprieve, a human rights NGO that focuses on cases linked to torture, say they have uncovered critical information which exposes UK intelligence services as having “shared information about Jagtar that led to his unlawful arrest and torture in India.”
The annual report by the UK’s investigatory powers commissioner includes censored details of how MI5 and MI6 passed information to a foreign power about a British national who was detained and tortured. Reprieve believe these details are about Jagtar Singh Johal, which makes UK authorities liable for Jaggi’s torture and detainment, which the United Nations called “arbitrary”.
The actions of the British intelligence services in 2017 when Jaggi was abducted in India occurred when Boris Johnson was the foreign secretary. Accoring to The Times newspaper, insiders say the sign-off on the transfer of such information could only have been given by the foreign secretary.
Gurpreet Singh Johal, the brother of Jaggi and a lawyer that heads the official #FreeJaggiNow campaign group, stated on Twitter his brother will be taking the UK Govt to court for these actions. Britain is bound by several international obligations not to surrender its citizens for torture. They include the UN Convention Against Torture and the European Convention on Human Rights, neither of which allow any exception.
As highlighted since his initial arrest, most Sikh community groups believe Jaggi is just the latest in a long line of Sikh activists targeted by the Indian state. Jaggi was known for his blogging of historic information of the Sikh resistance against the Indian state’s Sikh genocide.
Supporters of the #FreeJaggiNow campaign are guaranteed to react with shock to this news, which firmly points the finger back at the UK in regards to the situation. Why the UK would facilitate the arrest and torture of a Sikh activist blogger remains unclear, although many including Jaggi’s local MP Martin Docherty-Hughes of the SNP believe the Scotsman has been sacrificed to appease India with trade in mind between the nations. In 1984 before India infamously attacked the Sri Harmandir Sahib Gurdwara, communications between India and the UK revealed the UK decided to help by offering official SAS advice to India to ensure no issues came between trade between the countries.
A petition has been started by Reprieve to press Liz Truss into bringing Jaggi home and preventing any other Brits from suffering due to intelligence info again- Liz Truss: stop torture tip offs now (reprieve.org).

186th pre-trial hearing results in charge finally being made against Jaggi
After nearly five years, Jaggi’s pre-trial hearings at Patiala House (Delhi) has led to a formal charge being framed against the Scotsman.
The charge of conspiracy to murder is based on just one of six current ongoing cases against Jaggi, with the other cases to be heard on 27 & 28 July and 3 4 & 5 August 2022.
Dan Dolan Director of Advocacy at Reprieve, a charity against arbitrary imprisonment that have been supporting Jaggi’s plight, said: “Jagtar’s detention has been recognised as arbitrary by both the British prime minister and a group of UN legal experts.
“The framing of charges doesn’t change that. He remains imprisoned based on a false confession he signed after days of torture with electricity. There is no physical evidence to support these trumped-up political charges. This is self-evidently arbitrary detention.”
Jaggi’s brother and #FreeJaggiNow campaign lead Gurpreet Singh Johal also urged UK ministers to take action.
He said: “Even after they acknowledged he is arbitrarily detained, they continued to delay.
“The absurd charges framed today, built on a false torture confession, highlight the cost of that negligence.

UN rule Jaggi being imprisoned with “No legal basis”
The United Nation’s Working Group on Arbitrary Detention said that Johal has been detained “arbitrarily” and should be released immediately.
The working group are a panel of experts on illegal imprisonment and torture assigned by the UN to investigate situations like that of Jaggi’s current plight, after efforts by the Scotsman’s campaign team to have them look into the situation.
In a damning new finding on the case, it stated that there had been “violations of international human rights norms and standards in the arrest and detention of Mr. Johal” as well as “multiple violations of [his] right to a fair trial.”
It called on the Indian government “to take urgent action to ensure the immediate unconditional release of Mr. Johal” and “accord him an enforceable right to compensation and other reparations, in accordance with international law.”

Boris Johnson’s claim on “Khalistani Extremists” prompts concern about Jaggi’s arbitrary imprisonment
A claim that the UK has a problem with “Khalistani extremists” has prompted concern about the govt’s continued lack of support for Jagtar Singh Johal.
Without any evidence to prove it, Indian authorities have linked Jaggi with so-called Khalistani terrorism (linked to the murder of Indian nationalist leaders). Based on this conjecture, Jaggi has been imprisoned for nearly five years without being convicted of a crime.
As such, the statement by Johnson has been widely criticised and has prompted worry that the UK may enable the targeting of more Sikhs by India, similarly to how Jaggi has become a modern example of India’s relentless targeting of Sikh activists.

Jaggi’s wife wins deportation battle
The wife of Jagtar “Jaggi” Singh Johal has won a battle to stay in the UK, after previously having her stay rejected.
Mrs Johal, who will remain anonymous to protect her identity from Indian authorities looking for more angles to harass and threaten Jaggi, married the Scotsman in 2017 in Punjab, India. Despite Jaggi’s arbitrary detainment in India, Mrs Johal came to Scotland as planned to live with her in-laws, where it is also considered safer for her.
In late 2020 her application to stay in the UK was rejected by the UK Home Office, in a move deemed unusual for anyone marrying a British citizen, as Mrs Johal had done in 2017. For unclear reasons the UK Home Office rejected her stay despite an immigration judge granting her stay in the UK last year.
After fighting against Home Office plans to deport her, her brother-in-law Gurpreet Singh Johal – also an immigration lawyer – has announced she has won her stay in the UK. However, the UK Home Office can still appeal this decision and push for her deportation, as they previously did.
The news of her stay will be welcomed by many, including countless #FreeJaggiNow supporters that were gravely concerned for her safety had she been forced to return to India.

NIA claim they have lost witness statements at 147th pre-trial hearing
Jagtar Singh Johal, Scottish Sikh detained by India since November 2017, was presented in Patiala House Court today for his latest pre-trial hearing.
Once again, real progress in the case and an opportunity for the defence to make a case against the allegations against “Jaggi” were hindered as the NIA (National Investigation Agency) “claimed that four witness statements are lost and they have not been able to locate them and due to the financial burden of producing audio recordings (CD’s), they have not actioned these either.”
This lack of evidence against Jaggi shows why so many are distraught at his detainment, with nothing yet shown to prove or even really suggest his. Read the official statement here.

Documents reveal UK authorities collecting evidence against Jaggi
Newly revealed documents show that Jagtar Singh Johal is one of three Sikhs that have been having evidence collected against them by UK authorities, according to the #FreeJaggiNow team.
In 2018 terror unit raids against five UK Sikh men led to two Sikhs being placed on trial for breaches of the charities commission rules, despite not being part of a charity.
Documents now revealed from these raids have shown Jaggi was a third name alongside the other two – Kaur and Lehal -who was having evidence gathered against him.
This shocking revelation now casts further suspicion on UK authorities’ motives in his case, as trade deals between the UK and India continue to be at the fore of UK post-Brexit governance. See the official #FreeJaggiNow statement on this here.

Calls for Jaggi’s freedom renewed amid media storm on case
A human rights NGO (Non-Government Org) have renewed calls for the British government to “save Jagtar’s life” and “call for his release” after a flood of media coverage on the case today.
Reprieve released a statement in which the UK government was “urged to seek the release of British national Jagtar Singh Johal, after it was revealed that he is facing a death sentence in India”. The reference of the death sentence is based on additional capital murder charges stemming from a crime committed three years after he was imprisoned. Jaggi’s defence team have questioned the validity of this latest charge which could lead to the death sentence, pointing out he is under 24/7 watch and guard in prison without the ability to contact the outside world, making it laughable to suggest he has been committing crimes whilst imprisoned.
The Reprieve statement comes after mass UK media coverage on the case of ‘Jaggi’, the Scottish born and bred Sikh who has been arbitrarily detained in India since 2017. The glut of media coverage was sparked by an interview between Jaggi and the BBC’s South-Asia correspondent Rajini Vaidyanathan.
The interview was conducted second-hand through Jaggi’s lawyer Jaspal Singh Manjhpur, as Jaggi is still being kept away from journalists by the Indian authorities. Jaggi has also never been allowed a private meet with the British consulate and has gone months at a time without any contact allowed with any consulate representatives or being allowed to speak to his family. In the interview Jaggi discussed his previous forced signature of a “blank confession” and his torture.

New charge levelled against Jaggi
Despite being imprisoned for over three years now, Indian authorities have accused Jagtar Singh Johal of a new charge regarding an incident which took place whilst Jaggi was imprisoned.
Jaggi has now been taken into Delhi police custody for 14 days for interrogation about the crime that allegedly took place in October 2020, whilst Jaggi was incarcerated. Historically and in Jaggi’s specific case, torture is carried out by police during interrogation, prompting great concern for Jaggi’s wellbeing amongst his family and all his supporters.
